Subject: Class action lawsuit
Message #110108
What are the possibilities for filing a class action lawsuit against Apple/Emagic for discontinueing support for the PC Logic version, which basically renders our investment of thousands and thousands of dollars for Logic and Logic-compatible software/hardware/plugins completely useless? Any lawyers in this group? Feel free to send your praise to Apple to this e-mail addy: lfox@... He loves to hear your feedback :)

If Emagic could somehow send a signal through the Internet to actually make your Emagic products useless, then you'd have a point. But after Sept 30/2002 I bet LAW will still be quite useful (and it ought to be at version 5.2 or maybe higher by then). After all I'm still using Logic 4.81 on my TDM/Nubus Mac (no possibility for USB connection for the new dongle). f-erenc szabo, smarty pants (Tastes awful, but it works) Z+E+R+O+B+E+A+T "NOW POWERED BY THE MIRACLE OF THE TRANSISTOR!"

Well, Mr. Dash-In-Your-Name, do you actually have some insider information that would lead you to believe that Emagic will support LAW after Sept. 30 and make sure it continues to work with the latest OS updates? What makes you think that 5.2 will actually emerge for Windows? Don't you think there's a difference between a product that's simply 'quite useful' and one that has the full $700 of value that only really comes with the years of support/updates originally intended? I'm beginning to think that you're just a Perl script that spits out pro-Emagic rantings every time someone says something bad about the company. If you can stand by and say that today's events are congruous with good business practices, you're insane. And hey, you're the one with a dash in your name.

Well first of all, you'd probably have to wait until it were actually discontinued before you could file. Second, not having an upgrade path is not quite the same thing as your soft and hardware being rendered "completely useless." You still have software that works (and will continue to work) exactly as well as it did (or didn't) the day you bought it - i.e. you paid for what you got. Mind you, I wouldn't be chuffed about it if I were a LAWP user (hell, I'm not sure I'm chuffed about it as a LAMP user) but it would be a complete waste of your time to file a lawsuit. The best you could hope for is that people who upgraded to LAWP 5 and LC, get a chance to get a refund and even that would be a stretch for a judge to grant (No judge is going to mandate that Emagic continue development). I have no doubt that they will offer a free cross-grade to LAMP 5. Dayo PS. This information is not intended as legal advice. If you are concerned about your legal rights consult a lawyer in your jurisdiction. (I have to give this disclaimer, plus I'm only licensed to practice law in NY). > Any lawyers in this group? > > Feel free to send your praise to Apple to this e-mail addy: > > lfox@a... > > He loves to hear your feedback :)

1) What kind of crossgrade plan are they going to offer? (I think the Instal CD's are Mac/PC) - so it may be an Xkey swap -? 2) Will my Logic control work? (is there any sneaky mac/pc firmware) in the thing? 3) Not that i use it - but what about samplitude? ~Neil P
