If you follow this line of thought to its logical conclusion, what you end up with is a stagnant software industry where vendors will be reluctant to innovate and push forward new features in their products for fear of litigation. Nobody can guarantee that the software they sell will be free of bugs, and it certainly isn't malicious negligance that allows them to remain in the product.
